IP, IT & Privacy

Innovation, digitisation and new technology are the driving force behind our modern economy and bring about the greatest changes in our society. Often these changes are so innovative that the law does not yet have a clear answer to the challenges they pose. We take the time to understand your idea and identify the legal risks involved. We creatively seek solutions that protect your ideas, structure your collaborations and help commercialise your product. In doing so, we are also mindful of all the relevant privacy and data protection-related aspects.

Intellectual property – We ensure that your ideas are given the best possible protection within legal limits by registering, for example, patents, trademarks, trade names, designs, databases, and similar intellectual property rights. We assist you in exploiting these ideas by ensuring robust agreements that protect your copyright or registered intellectual property (including licensing agreements, collaborations, general terms and conditions, and other (complex) agreements). We act against infringements of your intellectual property and advise you on applicable tax concessions.

Technology – We offer a multidisciplinary approach, assisting you with legal issues posed by the implementation of innovative technology (such as artificial intelligence, Internet of Things (IoT), digital infrastructure, virtual and augmented reality (VR & AR), gaming, esports, blockchain, big data, and others). We advise on the (often new) regulatory environment for the digital economy, including privacy, AI, cybersecurity and data. We prepare (complex) IT agreements, such as on licensing, maintenance, consultancy, Software-as-a-Service (SaaS), Platform-as-a-Service (PaaS), Infrastructure-as-a-Service (IaaS), outsourcing, procurement, cloud computing, development and similar. We also offer expertise in telecommunications law, both during the launch of electronic communications services or networks, and in complying with the complex rules governing them.

Fintech – We combine our expertise in new technology with our knowledge of financial law to offer advice on regulatory issues relevant to your product (such as payment services regulation, MiFID, credit law, banking law, financial consumer law and virtual currency (crypto) regulation).

Privacy – Since the entry into force of the General Data Protection Regulation (GDPR), privacy has become an integral part of our world. Every business processes personal data in one way or another, whether it concerns staff, customers, members, suppliers, website visitors or others. We offer you expert advice in all aspects of data protection, from drafting all the necessary documentation (such as a privacy policy, cookie policy, processing agreements, internal policies and others) to issues on how to process data. We assist you with data subject requests, data breach reporting or Data Protection Authority investigations.
